Blanchard here:<\/p>\n\n\n\n<p><strong>ORDINANCE NO. 2021-6<\/strong><\/p>\n\n\n\n<p><strong>AN ORDINANCE REGARDING HIGH WEEDS AND GRASSES WITHIN THE VILLAGE; THE PROCEDURE FOR REQUESTING ORDINANCE AND STEPS TO BE TAKEN UPON NONCOMPLIANCE UPON PROPERTIES WITHIN THE LIMITS OF THE VILLAGE OF MOUNT BLANCHARD, OHIO. (REPLACEMENT OF 2010-10)<\/strong><\/p>\n\n\n\n<p><strong>SECTION l:&nbsp; WEEDS AND GRASSES<\/strong><\/p>\n\n\n\n<p>Any person owning or having charge of land within the Village of Mount Blanchard shall keep said property free and clear from all tall grass, noxious weeds and rank vegetation.&nbsp;&nbsp;<\/p>\n\n\n\n<p>A. The terms \u201ctall grass, noxious weeds and rank vegetation\u201d as used herein, shall<\/p>\n\n\n\n<p>include but not be limited to:<\/p>\n\n\n\n<p>1. Any weeds such as jimson, burdock, ragweed, thistle, cocklebur, or other weeds of a like kind.<\/p>\n\n\n\n<p>2. Any weeds, grasses, or plants other than trees, bushes, flowers or other<\/p>\n\n\n\n<p>ornamental plants, growing to a height exceeding 12 inches.<\/p>\n\n\n\n<p><strong>SECTION ll:&nbsp; ENFORCEMENT&nbsp;<\/strong><\/p>\n\n\n\n<p>A. Upon being informed, and confirming through personal inspection, that tall grass,<\/p>\n\n\n\n<p>noxious weeds or high vegetation is growing on land within the Village, the Mayor shall cause verbal or written notice to be served on the owner of the land and also upon any lessee, agent, or tenant having charge of such land, notifying him\/her that tall grass, noxious weeds or rank vegetation is growing on such land and that they must be cut and removed within five (5) days after receipt of the notice.&nbsp;<\/p>\n\n\n\n<p>1. The notice shall be served upon the owner, and any lessee, agent or tenant, in the following manner:&nbsp;&nbsp;<\/p>\n\n\n\n<p>a. Personally by<\/p>\n\n\n\n<p>b. In written form by way of letter, text and\/or email.<\/p>\n\n\n\n<p>B. Mayor shall be required to serve only one notice on an owner or other person having charge of the land in each calendar year; thereafter, an owner or other person having charge of the land who has received the notice shall be under a continuing duty to obey the same.&nbsp; Any further notices in that year may be by notice posted on the property with the date of Village action provided.<\/p>\n\n\n\n<p><strong>SECTION lll:<\/strong><strong> <\/strong><strong>&nbsp; CLEAN UP&nbsp;<\/strong><\/p>\n\n\n\n<p>A. If the owner, lessee, agent, or tenant having charge of the land fails to comply<\/p>\n\n\n\n<p>with the notice, the Mayor shall cause such tall grass, noxious weeds or rank vegetation to be cut and&nbsp; and may employ the necessary labor to perform that task.&nbsp; Expenses, incurred by the Village, for that purpose shall consist of the following:<\/p>\n\n\n\n<p>1. A minimum fee of two hundred dollars ($200.00) shall be charged per notification of ordinance violation and,one hundred dollars ($100.00) for every hour or part-hour thereafter for the cutting and removing of the tall grass, noxious weeds and rank vegetation.<\/p>\n\n\n\n<p><strong>SECTION lV:&nbsp; VILLAGE PROCESS FOR COMPENSATION<\/strong><\/p>\n\n\n\n<p>A. After tall grass, noxious weeds or rank vegetation have been cut and removed per requirements set forth by Village ordinance, the Mayor shall make a written return of expenses to the County Auditor of the Mayor\u2019s action, with a statement of the amount paid for labor and material along with proper legal description of the premises.<\/p>\n\n\n\n<p>1. A copy of the expenses shall be shared with the owner, lessee, agent or tenant having charge of such land and, thereby giving opportunity to compensate the Village.<\/p>\n\n\n\n<p>2. Blanchard, State of Ohio, two-thirds (2\/3) of all members elected thereto concurring:&nbsp;<\/p>\n\n\n\n<p>SECTION 1: That the annual base salary for the Village Administrator of the Village of Mt. Blanchard, commencing January 1, 2012, shall be Thirty-six Thousand One Hundred Twenty- seven and 62\/100 Dollars ($36,127.62) per year. In addition thereto, he shall receive Three Thousand Five Hundred and 00\/100 Dollars ($3,500.00) if he a possesses a Class 1 water license and an additional Three Thousand Five Hundred and 00\/100 Dollars ($3,500.00<strong>) <\/strong>if he possesses a Class 1 Sewer license. Said compensation shall be payable semi-monthly.&nbsp;<\/p>\n\n\n\n<p>The base annual salary shall be paid out of the following funds in the following percentages: 10% from the General Fund, 20% from the Water Fund, 35% from the Street Fund and 35% from the Sewer Fund. Compensation for the water and sewer licenses shall be paid out of the Water Fund and Sewer Fund respectively.&nbsp;<\/p>\n\n\n\n<p>SECTION 2: That the annual salary for the Village Fiscal Officer of the Village of Mt. Blanchard, commencing January 1, 2012, shall be Ten Thousand and 00\/100 Dollars ($10,000.00) per year payable semi-monthly at the rate of Four Hundred Sixteen and 67\/100 Dollars ($416.67). Said salary shall be paid out of the following funds:&nbsp;<\/p>\n\n\n\n<p>The General Fund shall be charged Five Thousand and 00\/100 Dollars ($5,000.00); Two Thousand Five Hundred and 00\/100 Dollars ($2,500.00) shall be charged to the Water Fund; and Two Thousand Five Hundred and 00\/100 Dollars ($2,500.00) shall be charged to the Sewer Fund.&nbsp;<\/p>\n\n\n\n<p>SECTION 3: That Donald J. Rasmussen, Attorney at Law, be and the same is hereby employed for Calendar Year 2012 as Village Solicitor for the Village of Mt. Blanchard, Ohio <strong>at <\/strong>an annual salary of Four Thousand Twenty and 00\/100 Dollars ($4,020.00) payable monthly at the rate of Three Hundred Thirty-five and 00\/100 Dollars ($335.00) from the General Fund.&nbsp;<\/p>\n\n\n\n<p>SECTION 4: This Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety of the inhabitants of the Village of Mt. Blanchard, Ohio, and for the further reason that it is immediately necessary to enact said legislation so that said salaries shall be effective beginning January 1, 2012.&nbsp;<\/p>\n\n\n\n<p>SECTION 5: Wherefore, this Ordinance shall take effect and be in force from and after its passage and approval by the Mayor.&nbsp;<\/p>\n\n\n\n<p>PRESIDENT OF COUNCIL&nbsp;<\/p>\n\n\n\n<p>MAYOR&nbsp;<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>ORDINANCE NO<strong>. 2015-02&nbsp;<\/strong><\/p>\n\n\n\n<p>AN ORDINANCE ESTABLISHING A SALARY <strong>FOR <\/strong><strong>THE <\/strong><strong>POSITION <\/strong><strong>OF <\/strong>VILLAGE ADMINISTRATOR, GRANTING VACATION, ESTABLISHING A HOLIDAY SCHEDULE, GRANTING SICK LEAVE, REPEALING ALL ORDINANCES IN <strong>CONFLICT <\/strong>HEREWITH, AND DECLARING AN EMERGENCY.&nbsp;<\/p>\n\n\n\n<p>BE IT ORDAINED by the Village of Mt. Blanchard, State of Ohio, two-thirds (2\/3) of all members elected thereto concurring:&nbsp;<\/p>\n\n\n\n<p>SECTION 1: REPEAL. That all ordinances in conflict herewith be and the same are hereby repealed.&nbsp;<\/p>\n\n\n\n<p>SECTION 2: VILLAGE ADMINISTRATOR. That retroactive to the November 16th payroll period, 2014, the Village Administrator shall be paid a salary as follows:&nbsp;<\/p>\n\n\n\n<p>Job Classification&nbsp;<\/p>\n\n\n\n<p>Village Administrator&nbsp;<\/p>\n\n\n\n<p>*Salary&nbsp;<\/p>\n\n\n\n<p>$32,500.00\/annually&nbsp;<\/p>\n\n\n\n<p>SECTION 3: That the Village Administrator shall receive and the Village shall recognize the following holidays New Years Day; Memorial Day; Independence day (July 4th); Labor Day; Veterans Day; Thanksgiving Day; and Christmas Day.&nbsp;<\/p>\n\n\n\n<p>SECTION 4: That Sick Time accrual and accrual payments shall comply with those requirements set forth in \u00a7\u00a7 124.38 and 124.39 of the Ohio Revised Code. Sick leave shall accrue at 4.6 hours for each eighty hours worked, excluding overtime, or the equivalent of fifteen (15) days per year.&nbsp;<\/p>\n\n\n\n<p>SECTION 5: That this Ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health and safety of the inhabitants of the Village of Arlington and for the further reason it is immediately necessary to enact said salary schedule to provide for payment to said employee retroactive to the date specified above.&nbsp;<\/p>\n\n\n\n<p>WHEREFORE, this Ordinance shall take effect and be in force from and after its passage and approval by the Mayor.&nbsp;<\/p>\n\n\n\n<p>Donatal H. BLANCHARD<strong>, <\/strong>OHIO, <strong>AT THE <\/strong><strong>RATE <\/strong><strong>OF <\/strong><strong>1.5 <\/strong>MILLS <strong>OF <\/strong><strong>THE <\/strong><strong>TAX <\/strong>VALUE <strong>OF <\/strong><strong>THE <\/strong><strong>PROPERTY <\/strong><strong>ASSESSED <\/strong><strong>TO <\/strong><strong>PROVIDE <\/strong><strong>FOR <\/strong><strong>THE <\/strong>REPAIR<strong>, <\/strong><strong>MAINTENANCE <\/strong><strong>AND <\/strong><strong>INSTALLATION <\/strong><strong>OF <\/strong><strong>STREETS<\/strong>, <strong>ALLEYS <\/strong><strong>AND <\/strong>SIDEWALKS WITHIN <strong>THE <\/strong>VILLAGE <strong>OF <\/strong><strong>MT<\/strong>. <strong>BLANCHARD<\/strong><strong>, <\/strong><strong>OHIO<\/strong>, AND <strong>DECLARING <\/strong><strong>AN <\/strong><strong>EMERGENCY<\/strong><strong>.&nbsp;<\/strong><\/p>\n\n\n\n<p><strong>WHEREAS<\/strong><strong>, <\/strong><strong>the <\/strong>Village <strong>of <\/strong>Mt. <strong>Blanchard <\/strong>is without <strong>funds <\/strong>to <strong>properly <\/strong><strong>maintain <\/strong><strong>the <\/strong>streets, <strong>alleys <\/strong>and <strong>sidewalks <\/strong>within <strong>the <\/strong><strong>Village<\/strong><strong>, <\/strong><strong>and<\/strong><strong>;&nbsp;<\/strong><\/p>\n\n\n\n<p>WHEREAS, it is <strong>deemed <\/strong>necessary <strong>and <\/strong>conducive to <strong>the <\/strong>safety, comfort, <strong>convenience <\/strong><strong>and <\/strong><strong>welfare <\/strong><strong>of <\/strong><strong>the <\/strong>citizens <strong>of <\/strong>this community <strong>to <\/strong><strong>have <\/strong><strong>adequate <\/strong>streets<strong>, <\/strong><strong>alleys <\/strong>and sidewalks at all times, and<strong>;&nbsp;<\/strong><\/p>\n\n\n\n<p><strong>WHEREAS<\/strong><strong>, <\/strong>Section <strong>727.01 <\/strong><strong>of <\/strong>the <strong>Ohio <\/strong>Revised Code, <strong>provides <\/strong>a <strong>method <\/strong>of special assessment <strong>by <\/strong><strong>which <\/strong><strong>any <\/strong><strong>part <\/strong><strong>of <\/strong><strong>such <\/strong>cost <strong>may <\/strong>be <strong>assessed <\/strong>against <strong>the <\/strong><strong>benefitted property <\/strong><strong>and <\/strong><strong>it <\/strong>is now <strong>determined <\/strong><strong>that <\/strong><strong>each <\/strong><strong>and <\/strong>every <strong>lot <\/strong><strong>or <\/strong>parcel of <strong>land <\/strong><strong>within <\/strong><strong>the <\/strong><strong>corporation <\/strong><strong>by <\/strong><strong>reason <\/strong>of a depreciated value <strong>in <\/strong><strong>the <\/strong>event that adequate streets<strong>, <\/strong><strong>alleys <\/strong>and <strong>sidewalks <\/strong><strong>were <\/strong><strong>not <\/strong><strong>available<\/strong>.&nbsp;<\/p>\n\n\n\n<p><strong>NOW<\/strong><strong><em>, <\/em><\/strong>THEREFORE, BE <strong>IT <\/strong>ORDAINED <strong>by <\/strong><strong>the <\/strong><strong>Village of <\/strong>Mt. <strong>Blanchard<\/strong><strong>, <\/strong><strong>Ohio<\/strong><strong>, <\/strong>two-<strong>thirds <\/strong><strong>(<\/strong><strong>2\/3<\/strong><strong>) <\/strong><strong>of <\/strong><strong>all <\/strong><strong>members <\/strong><strong>elected <\/strong><strong>thereto <\/strong>concurring<strong>:&nbsp;<\/strong><\/p>\n\n\n\n<p><strong>SECTION <\/strong><strong>1<\/strong>: <strong>That <\/strong>the assessment <strong>of <\/strong>the cost <strong>and <\/strong><strong>expense<\/strong>, <strong>except <\/strong><strong>a <\/strong>fiftieth <strong>part <\/strong><strong>thereof<\/strong><strong>, <\/strong><strong>of <\/strong>paving, <strong>maintaining<\/strong><strong>, <\/strong>installing <strong>and improving <\/strong><strong>in <\/strong><strong>and <\/strong><strong>maintaining <\/strong><strong>in <\/strong><strong>any <\/strong><strong>manner <\/strong><strong>streets<\/strong>, alleys<strong>, <\/strong><strong>and <\/strong><strong>sidewalks <\/strong><strong>throughout <\/strong><strong>the <\/strong>Village <strong>of <\/strong>Mt. Blanchard<strong>, <\/strong><strong>Ohio<\/strong>, <strong>be <\/strong><strong>and <\/strong><strong>is <\/strong><strong>hereby <\/strong><strong>levied <\/strong>upon all lots <strong>and <\/strong><strong>lands <\/strong>within <strong>said <\/strong><strong>Village<\/strong>, <strong>which <\/strong>assessments shall be <strong>the <\/strong>rate of 1.5 <strong>mills <\/strong><strong>of <\/strong><strong>the <\/strong><strong>tax <\/strong><strong>value <\/strong><strong>of <\/strong><strong>the <\/strong><strong>property <\/strong>assessed <strong>as <\/strong><strong>listed <\/strong><strong>on <\/strong><strong>the tax <\/strong>records <strong>in <\/strong><strong>the <\/strong>County Auditor&#8217;s Office, <strong>and <\/strong>are not <strong>in <\/strong>excess of any statutory limitation. <strong>Said <\/strong>assessments <strong>shall <\/strong>be for <strong>the <\/strong>2016 <strong>tax <\/strong><strong>year<\/strong>.&nbsp;<\/p>\n\n\n\n<p><strong>SECTION <\/strong>2: <strong>That <\/strong><strong>one<\/strong><strong>&#8211;<\/strong>fiftieth <strong>of <\/strong>the <strong>part <\/strong>of <strong>the <\/strong>cost of paving, maintaining, <strong>installing <\/strong><strong>and <\/strong><strong>improving <\/strong><strong>in <\/strong><strong>and <\/strong><strong>maintaining <\/strong><strong>in <\/strong><strong>any <\/strong>manner streets, alleys and sidewalks <strong>throughout <\/strong><strong>the <\/strong><strong>Village <\/strong><strong>of <\/strong>Mt. <strong>Blanchard<\/strong>, <strong>Ohio<\/strong><strong>, <\/strong>shall <strong>be <\/strong><strong>paid <\/strong><strong>by <\/strong><strong>the <\/strong><strong>Village <\/strong><strong>of <\/strong>Mt. <strong>Blanchard <\/strong><strong>from <\/strong><strong>the <\/strong><strong>General Fund <\/strong><strong>to <\/strong>be collected as <strong>other <\/strong><strong>general taxes<\/strong>.&nbsp;<\/p>\n\n\n\n<p><strong>SECTION <\/strong><strong>3<\/strong><strong>: <\/strong>That <strong>the <\/strong>total assessment <strong>against <\/strong>each lot or parcel of land shall <strong>be payable <\/strong><strong>in <\/strong>each case <strong>within <\/strong>Thirty <strong>(<\/strong><strong>30<\/strong>) <strong>days <\/strong>from <strong>and <\/strong>after <strong>the <\/strong><strong>passage <\/strong><strong>of <\/strong>this <strong>ordinance <\/strong>and <strong>publication <\/strong>of <strong>legal <\/strong>notice<strong>. <\/strong>All assessments remaining <strong>unpaid <\/strong><strong>at <\/strong><strong>the <\/strong>expiration of <strong>said <\/strong><strong>Thirty <\/strong><strong>(<\/strong><strong>30<\/strong><strong>) <\/strong><strong>days <\/strong><strong>shall <\/strong>be certified <strong>by <\/strong><strong>the <\/strong><strong>Clerk <\/strong><strong>of <\/strong>this <strong>Council <\/strong><strong>to <\/strong><strong>the <\/strong><strong>County <\/strong>Auditor, <strong>as <\/strong><strong>provided <\/strong><strong>by <\/strong>law <strong>to <\/strong>be <strong>by <\/strong>him <strong>placed <\/strong><strong>on <\/strong>the <strong>tax <\/strong><strong>duplicate <\/strong><strong>and <\/strong><strong>collected <\/strong><strong>as <\/strong><strong>other <\/strong><strong>taxes <\/strong><strong>are <\/strong><strong>collected<\/strong>.&nbsp;<\/p>\n\n\n\n<p><strong>SECTION <\/strong><strong>4<\/strong><strong>: <\/strong>That the assessments so collected <strong>shall <\/strong><strong>be <\/strong><strong>placed <\/strong><strong>in <\/strong><strong>a <\/strong><strong>separate <\/strong><strong>and <\/strong><strong>distinct <\/strong><strong>fund <\/strong><strong>and <\/strong><strong>shall <\/strong>be used for no other purpose <strong>hereby <\/strong><strong>declared to <\/strong><strong>be <\/strong><strong>an <\/strong><strong>emergency <\/strong>measure <strong>necessary <\/strong><strong>for <\/strong><strong>the <\/strong><strong>immediate <\/strong>preservation of <strong>the <\/strong><strong>public <\/strong><strong>peace<\/strong>, health <strong>and <\/strong>safety <strong>of <\/strong><strong>the Blanchard, Ohio, is without funds to grade, drain, curb, pave, re-pave, repair, treat the surface of street with substances designed to preserve such surface of the streets, alleys, and public roads within the Village and,&nbsp;<\/p>\n\n\n\n<p><strong>WHEREAS<\/strong><strong>, <\/strong>\u00a7727.01 of the revised code of the state of Ohio provides a method of special assessment by which such costs may be assessed against the benefited property and it is now determined that each and every parcel of land and lot within the corporation limits of the Village of Mt. Blanchard, is specially benefited by reason of a depreciated value in the event that the streets, alleys, and public roads fall into disrepair.&nbsp;<\/p>\n\n\n\n<p><strong>NOW<\/strong>, <strong>THEREFORE <\/strong><strong>BE <\/strong>IT <strong>ORDAINED <\/strong>by the Council of the Village of Mt. Blanchard, Ohio:&nbsp;<\/p>\n\n\n\n<p><strong>SECTION <\/strong><strong>1<\/strong><strong>: <\/strong>That the assessment of the cost and expense except a fiftieth part thereof, and the cost of all intersections for the grading, draining, curbing, paving, repaving, repairing, and treating of the surfaces with substances designed to preserve such surfaces of the streets, alleys, and public roads of the Village of Mt. Blanchard, as now installed, be an is hereby levied upon all lots and land within the Village and which assessment shall be at a rate of 1.5 mills of the tax value of the property assessed as listed on the tax records in the County Auditor&#8217;s office and are not in excess of any statutory limitations.&nbsp;<\/p>\n\n\n\n<p><strong>SECTION <\/strong><strong>2<\/strong><strong>: <\/strong>That one fiftieth part of the cost and the cost of all intersections of streets, alleys, and public roads of the Village of Mt. Blanchard shall be paid by the Village of Mt. Blanchard from the general tax to be collected as any other general taxes.&nbsp;<\/p>\n\n\n\n<p><strong>SECTION <\/strong><strong>3<\/strong><strong>: <\/strong>That the total assessments against each lot or parcel of land shall be payable in cash within fifteen days from and after the passage of this Ordinance and publication of legal notice. Blanchard, State of Ohio, two- thirds (2\/3) of all members elected thereto concurring:&nbsp;<\/p>\n\n\n\n<p>SECTION 1: That the Village of Mt. Blanchard shall and hereby does establish parking restrictions in the Village during an emergency as a result of snowfall as follows:&nbsp;<\/p>\n\n\n\n<p>(a) In the event of snowfall in the Village in the amount of two inches or more during any period of twenty-four hours or less, and the Mayor finds that such heavy snowfall constitutes a serious public hazard impairing transportation, the movement of food and fuel supplies, the availability of medical care, fire, health and police protection, or threatens vital operations or facilities of the Village, the Mayor shall declare an emergency. The emergency shall continue until the Mayor or Street Commissioner announces that snow plowing operations have been completed.&nbsp;<\/p>\n\n\n\n<p>(b) In the event an emergency is declared due to heavy snowfall, the Mayor shall request the cooperation of the local press, radio stations and other communications media to announce the declaration of emergency and the times at which emergency parking regulations shall be effective. Emergency parking regulations shall become effective one hour after the first announcement of the declaration of emergency, and such announcement by the local radio station or newspaper of general circulation shall constitute notice to the public of the existence of an emergency. Owners and operators of motor vehicles shall be fully responsible for determining when existing weather conditions constitute an emergency, and for complying with emergency parking regulations when such emergency is declared.&nbsp;<\/p>\n\n\n\n<p>(c) Whenever an emergency is declared under this section, the Mayor and Street Commissioner may prohibit the parking of any vehicles on any or all of the Village streets. During any emergency, it shall be unlawful for any person to park or cause to be parked, or permit to remain parked, or to abandon or to leave unattended, any vehicle of any kind or description on such specified streets. However, vehicles may be parked for a period not longer than three minutes for actual loading or unloading of property, if no other ordinance restricting parking is thereby violated.&nbsp;<\/p>\n\n\n\n<p>(d) The Mayor or Street Commissioner may order the removal of any vehicle which may interfere with the operation of any snow removal equipment or any emergency vehicle. The Mayor or Street Commissioner shall affect such removal of vehicles through the Hancock County Sheriff&#8217;s Department. The cost of removal of any vehicle shall be paid by the owner or operator thereof.&nbsp;<\/p>\n\n\n\n<p>(e) No person shall park or stop any vehicle on any un-cleared street or alley either during a severe snowstorm, immediately thereafter, or during a state of emergency as declared under this Code, in such a manner as to interfere with snow removal equipment.&nbsp;<\/p>\n\n\n\n<p>(f) In the event an emergency is declared under this Ordinance, such streets as are designated by the Mayor or Street Commissioner are declared to be priority streets, and all parking, as hereinabove described, is prohibited thereon, commencing one hour after declaration of such an emergency.&nbsp;<\/p>\n\n\n\n<p>(g) On all streets not designated, parking is prohibited for a period commencing six hours after a declaration of emergency under this section and continuing until the Mayor or Street Commissioner announces that all snow plowing operations have been completed. Normal parking may be resumed on any and all streets where not violative of existing ordinances and regulations, on public announcement by the Mayor or Street Commissioner that snow plow operations are completed, or when streets have had snow removed to the curb line.&nbsp;<\/p>\n\n\n\n<p>SECTION 2: Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.&nbsp;<\/p>\n\n\n\n<p>SECTION 3: That this ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health, and safety of the inhabitants of the Village of Mt. Blanchard, commencing January 1, 2011, shall be Ten Thousand and 00\/100 Dollars ($10,000.00) per year payable semi-monthly at the rate of Four Hundred Sixteen and 67\/100 Dollars ($416.67). The emergency shall continue until the Mayor or Street Commissioner announces that snow plowing operations have been completed.&nbsp;<\/p>\n\n\n\n<p>(b) In the event an emergency is declared due to heavy snowfall, the Mayor shall request the cooperation of the local press, radio stations and other communications media to announce the declaration of emergency and the times at which emergency parking regulations shall be effective. Emergency parking regulations shall become effective one hour after the first announcement of the declaration of emergency, and such announcement by the local radio station or newspaper of general circulation shall constitute notice to the public of the existence of an emergency. Owners and operators of motor vehicles shall be fully responsible for determining when existing weather conditions constitute an emergency, and for complying with emergency parking regulations when such emergency is declared.&nbsp;<\/p>\n\n\n\n<p>(c) Whenever an emergency is declared under this section, the Mayor and Village Administrator may prohibit the parking of any vehicles on any or all of the Village streets. During any emergency, it shall be unlawful for any person to park or cause to be parked, or permit to remain parked, or to abandon or to leave unattended, any vehicle of any kind or description on such specified streets. However, vehicles may be parked for a period not longer than three minutes for actual loading or unloading of property, if no other ordinance restricting parking is thereby violated.&nbsp;<\/p>\n\n\n\n<p>(d) The Mayor or Village Administrator may order the removal of any vehicle which may interfere with the operation of any snow removal equipment or any emergency vehicle. The Mayor or Village Administrator shall affect such removal of vehicles through the Hancock County Sheriff&#8217;s Department. The cost of removal of any vehicle shall be paid by the owner or operator thereof.&nbsp;<\/p>\n\n\n\n<p>(e) No person shall park or stop any vehicle on any un-cleared street or alley either during a severe snowstorm, immediately thereafter, or during a state of emergency as declared under this Code, in such a manner as to interfere with snow removal equipment.&nbsp;<\/p>\n\n\n\n<p>(f) In the event an emergency is declared under this Ordinance, such streets as are designated by the Mayor or Village Administrator are declared to be priority streets, and all parking, as hereinabove described, is prohibited thereon, commencing one hour after declaration of such an emergency.&nbsp;<\/p>\n\n\n\n<p>(g) On all streets not designated, parking is prohibited for a period commencing six hours after a declaration of emergency under this section and continuing until the Mayor or Village Administrator announces that all snow plowing operations have been completed. Normal parking may be resumed on any and all streets where not violative of existing ordinances and regulations, on public announcement by the Mayor or Village Administrator that snow plow operations are completed, or when streets have had snow removed to the curb line.&nbsp;<\/p>\n\n\n\n<p>SECTION 2: Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.&nbsp;<\/p>\n\n\n\n<p>SECTION 3: That this ordinance is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, health, and safety of the inhabitants of the Village of Mt. This subsection shall not apply during the time which any such vehicle is parked for loading or unloading purposes only if such activity is conducted diligently and without unnecessary delay.&nbsp;<\/p>\n\n\n\n<p>(b) All trucks, trailers or other commercial vehicles of two tons capacity and above, being more than twenty feet in length, are prohibited from parking on any of the streets, alleys or other thoroughfares of the Village with the motor running for a period of more than ten minutes.&nbsp;<\/p>\n\n\n\n<p>(c) Subsections (a) and (b) hereof shall not apply to any emergency vehicles or to any other vehicle which is temporarily disabled and unable to proceed.&nbsp;<\/p>\n\n\n\n<p>(d) Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misderneanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.&nbsp;SECTION 2: That this Ordinance shall take effect and be in force from and after the earliest period provided by law.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p>ORDINANCE NO<strong>. <\/strong>2015-04&nbsp;<\/p>\n\n\n\n<p>AN ORDINANCE RESTRICTING CERTAIN SIZE VEHICLES FROM PARKING ON THE STREETS WITHIN THE VILLAGE LIMITS AND IMPOSING PENALTIES FOR <strong>A <\/strong>VIOLATION OF SAID RESTRICTIONS.&nbsp;<\/p>\n\n\n\n<p>WHEREAS, the Village of Mt. Blanchard, Ohio is receiving complaints regarding persons parking large vehicles on the public streets; and,&nbsp;<\/p>\n\n\n\n<p>WHEREAS, these vehicles cause excessive wear and tear on the Village streets; disturb the peace and quiet of the community when left running; interfere and\/or block traffic within the Village and create a nuisance for abutting and neighboring property owners.&nbsp;<\/p>\n\n\n\n<p>NOW THEREFORE, BE IT ORDAINED by the council of the Village of Mt. and&nbsp;<\/p>\n\n\n\n<p><strong>WHEREAS<\/strong><strong>, <\/strong>the Solid Waste Management Policy Committee for the District completed the 1995 amended Plan in accordance with the \u00a7\u00a73734.53 through 3734.55 of the Ohio Revised Code; and&nbsp;<\/p>\n\n\n\n<p><strong>WHEREAS<\/strong>, pursuant to the 1995 plan and Ohio Revised Code, \u00a7 3734.54, the District solid Waste Management Plan must be revised every five (5) years for an new planning period of greater than ten (10) years; and&nbsp;<\/p>\n\n\n\n<p><strong>WHEREAS<\/strong><strong>, <\/strong>pursuant to the 1995 Plan, the Policy Committee has revised the Hancock County Solid Waste Management Plan in accordance with the Ohio Revised Code and the new format prescribed by the Ohio EPA; and&nbsp;<\/p>\n\n\n\n<p><strong>WHEREAS<\/strong><strong>, <\/strong>the Hancock County Solid Waste Policy Committee submitted the draft of the 2013 Revised Plan to the Ohio EPA Director for preliminary review and comment and received the Agency&#8217;s written non-binding advisory opinion regarding the draft of the 2013 Revised Plan on September 5, 2013; and&nbsp;<\/p>\n\n\n\n<p><strong>WHEREAS<\/strong>, after making revisions to the Plan in response to the non-binding comments from the agency, the Policy Committee established a review time and held the appropriate public hearings necessary to pursue and received legislative approval of the &#8220;Final 2013 Revised Plan&#8221;; and&nbsp;<\/p>\n\n\n\n<p><strong>WHEREAS<\/strong>, the Hancock County Solid Waste Policy Committee, upon completion of the final draft of the 2013 Revised Final Solid Waste Management Plan, established the written and public comment period from August 26, 2013 through September 25, 2013 and scheduled a public hearing to receive oral comments concerning the final draft of the 2013 Revised Plan on October 1, 2013; and&nbsp;<\/p>\n\n\n\n<p><strong>WHEREAS<\/strong><strong>, <\/strong>the Hancock County Solid Waste Policy Committee, after consideration of the comments and recommendations received concerning the draft of the 2013 Revised Plan, adopted the same pursuant to a Policy Committee Resolution dated October 1, 2013; Blanchard, during the calendar year 2023, will be in need of goods and services for the general operations of the Village; and&nbsp;<\/p>\n\n\n\n<p>WHEREAS: It is necessary to obtain and enter into contracts for necessary materials, equipment, supplies, and services for the use by the Village in the calendar year 2023, and in order to obtain the best prices <strong>for <\/strong>such items and to assure that said items are available to the Village when needed.&nbsp;<\/p>\n\n\n\n<p>NOW THEREFORE BE IT ORDAINED by a majority vote of all members of the legislative authority elected thereto that:&nbsp;<\/p>\n\n\n\n<p>SECTION 1. (REPLACEMENT OF 2010-10)<\/strong><\/p>\n\n\n\n<p><strong>SECTION l:&nbsp; WEEDS AND GRASSES<\/strong><\/p>\n\n\n\n<p>Any person owning or having charge of land within the Village of Mount Blanchard shall keep said property free and clear from all tall grass, noxious weeds and rank vegetation.&nbsp;&nbsp;<\/p>\n\n\n\n<p>A. The terms \u201ctall grass, noxious weeds and rank vegetation\u201d as used herein, shall<\/p>\n\n\n\n<p>include but not be limited to:<\/p>\n\n\n\n<p>1. Any weeds such as jimson, burdock, ragweed, thistle, cocklebur, or other weeds of a like kind.<\/p>\n\n\n\n<p>2. Any weeds, grasses, or plants other than trees, bushes, flowers or other<\/p>\n\n\n\n<p>ornamental plants, growing to a height exceeding 8 inches.<\/p>\n\n\n\n<p><strong>SECTION ll:&nbsp; ENFORCEMENT&nbsp;<\/strong><\/p>\n\n\n\n<p>A. Upon being informed, and confirming through personal inspection, that tall grass,<\/p>\n\n\n\n<p>noxious weeds or high vegetation is growing on land within the Village, the Mayor shall cause verbal or written notice to be served on the owner of the land and also upon any lessee, agent, or tenant having charge of such land, notifying him\/her that tall grass, noxious weeds or rank vegetation is growing on such land and that they must be cut and removed within five (5) days after receipt of the notice.&nbsp;<\/p>\n\n\n\n<p>1. The notice shall be served upon the owner, and any lessee, agent or tenant, in the following manner:&nbsp;&nbsp;<\/p>\n\n\n\n<p>a. Personally by<\/p>\n\n\n\n<p>b. In written form by way of letter, text and\/or email.<\/p>\n\n\n\n<p>B. Mayor shall be required to serve only one notice on an owner or other person having charge of the land in each calendar year; thereafter, an owner or other person having charge of the land who has received the notice shall be under a continuing duty to obey the same.&nbsp; Any further notices in that year may be by notice posted on the property with the date of Village action provided.<\/p>\n\n\n\n<p><strong>SECTION lll:<\/strong><strong> <\/strong><strong>&nbsp; CLEAN UP&nbsp;<\/strong><\/p>\n\n\n\n<p>A. If the owner, lessee, agent, or tenant having charge of the land fails to comply<\/p>\n\n\n\n<p>with the notice, the Mayor shall cause such tall grass, noxious weeds or rank vegetation to be cut and&nbsp; and may employ the necessary labor to perform that task.&nbsp; Expenses, incurred by the Village, for that purpose shall consist of the following:<\/p>\n\n\n\n<p>1. A minimum fee of two hundred dollars ($200.00) shall be charged per notification of ordinance violation and,one hundred dollars ($100.00) for every hour or part-hour thereafter for the cutting and removing of the tall grass, noxious weeds and rank vegetation.<\/p>\n\n\n\n<p><strong>SECTION lV:&nbsp; VILLAGE PROCESS FOR COMPENSATION<\/strong><\/p>\n\n\n\n<p>A. After tall grass, noxious weeds or rank vegetation have been cut and removed per requirements set forth by Village ordinance, the Mayor shall make a written return of expenses to the County Auditor of the Mayor\u2019s action, with a statement of the amount paid for labor and material along with proper legal description of the premises.<\/p>\n\n\n\n<p>1. A copy of the expenses shall be shared with the owner, lessee, agent or tenant having charge of such land and, thereby giving opportunity to compensate the Village.<\/p>\n\n\n\n<p>2.
